2. Definitions

For the purposes of these Terms of Service:

• "Service" refers to the Chess Scanner platform and all related features
• "User" refers to any individual who creates an account or uses our Service
• "Token" refers to digital credits that allow the processing of one chess game
• "Processing" refers to the digitization and conversion of uploaded score sheets
• "Account" refers to the user profile created to access our Service
• "We," "Us," "Our" refers to the operators of Chess Scanner
• "Content" refers to any images, data, or information uploaded by Users

3. Service Description

Chess Scanner is a digital service for converting handwritten score sheets into digital formats. The service operates through a token-based payment system.

4. Payments and Billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.

• Payments are due immediately
• Tokens are activated immediately after successful payment
• All prices include applicable taxes
• Refunds are processed according to our refund policy Refund Policy

5. Token System

Our service is based on a prepaid token system:

• Tokens must be purchased before use
• Each scan operation consumes one token
• Tokens are not transferable between user accounts
• Unused tokens do not expire

6. User Responsibilities

As a user, you agree to:

• Only upload chess score sheets that you own or have the right to upload and digitize
• Respect intellectual property rights and not upload copyrighted material without proper authorization
• Use the service in accordance with its intended purpose and not attempt to abuse, hack, or overload our systems
• Maintain the confidentiality of your account credentials and not share your account with others
• Ensure uploaded images contain only chess-related content and no inappropriate material

7. Privacy and Uploads

Uploaded chess score sheets are used exclusively for processing:

• Images are automatically deleted after 14 days of inactivity of the progress states
• Secure transmission of all data via HTTPS
• Detailed information in our privacy policy

8. Service Availability

We strive for high availability but cannot guarantee 100% uptime.

9. Disclaimer

The accuracy of digitization depends on the quality of the scanned notations. We do not guarantee 100% accuracy of results and are not liable for any resulting damages.

10. Refunds

For detailed information about refunds, please refer to our Refund Policy. In summary:

• Within 14 days of purchase only if no tokens have been used
• At our discretion for legitimate complaints

11. Termination

Either party may terminate use at any time. If terminated by us, unused tokens will be proportionally refunded.

12. Changes to Terms

We reserve the right to modify these Terms of Service. Changes will be announced via email or through our website and take effect 30 days after announcement.

13. Applicable Law

These Terms of Service are governed by German law. The place of jurisdiction is the location of our company headquarters.

14. Intellectual Property

You retain ownership of your uploaded chess score sheets. We claim no ownership rights over your content. Our service, software, and branding remain our intellectual property.

15. Account Security

Users are responsible for maintaining account security. We may suspend accounts for suspicious activity or terms violations. Account sharing is prohibited.

16. Service Limits

We reserve the right to impose reasonable usage limits to ensure fair access for all users. Excessive automated usage may result in account restrictions.

17. Force Majeure

We are not liable for service interruptions due to circumstances beyond our control, including natural disasters, government actions, or technical infrastructure failures.
